  1. Know the Contract Deadlines
  • Contracts include an Option period and a Financing period. If your client terminates before either deadline, they’ll get their earnest money back.
  1. Ask for Written Guarantees
  • If a loan officer can’t provide a written guarantee that the loan will close—or that earnest money will be refunded if it doesn’t—your client needs a backup plan immediately.
  1. Understand the Property Approval Clause
  • The Property Approval clause allows termination up to three days before closing with a refund of earnest money. This is the last chance to protect your clients, so ensure guarantees are in place well before this deadline.
